The Benton County Board of Supervisors met in regular adjourned session with Supervisors Primmer, Wiley and Bierschenk were present. The meeting was called to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously.

Bob Fischer came to the meeting to ask about the lease agreement, what the status was. Supervisor’s advised Fischer to follow up with the County Attorney, he will be the one drawing up the legal document.

Wiley moved/Bierschenk seconded: To approve Resolution #18-20, Variance to the Sub-Division Ordinance. Motion carried.

RESOLUTION #18-20

Variance to the Benton County Subdivision Ordinance

WHEREAS, Benton County adopted the Benton County Subdivision Ordinance #72; and

WHEREAS, said ordinance prohibits the creation of multiple splits within a 40-acre aliquot part; and

WHEREAS, said ordinance sets forth the minimum requirements and improvements for subdivisions created in the unincorporated area of Benton County; and

WHEREAS, a request has been presented to the Board of Supervisors by W. Lee Raub, Ricky L. Raub and Joanne Louise Witter to vary the requirements of the ordinance to allow for two non-buildable tracts of land by plat of survey on a parcel located within the SW ¼ SW ¼ of 29-85-12.

NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that the requirements of Ordinance #72 are hereby varied in its entirety for two additional divisions of real property located in the parcel located within the SW ¼ SW ¼ of 29-85-12.

The time of 9:15 a.m. having arrived, the board opened the public hearing on a land use change requested by Roger and Karen Lough. Marc Greenlee presented the technical information in accordance with the Benton County Agricultural Land Use Preservation Ordinance. The change in use is for approximately 2 acres located in part of a 13 acre parcel in the SE1/4 SE ¼ of section 31-82-11. The request is to change the classification to a residential use. The property has an existing driveway that meets requirements, but will be improved. CSR is 30, and this is not in production. Bierschenk moved/Wiley seconded: to approve the request for a land use change from agricultural to non-agricultural use on approximately 2 acres for a residential purpose on a parcel generally described as being located in part of SE ¼ SE ¼ of section 31-82-11. Motion carried.

Wiley moved/Bierschenk seconded: To approve both sets of the minutes of April 3, 2018 and April 6, 2018 with a few corrections. Motion carried.

Larry Andreesen, Benton County Assessor discussed the assessment put on the old DHS building. It will go from exempt back into Commercial taxation due to the county renting to those businesses currently displaced from the downtown fire. The Board was concerned with the assessment being too high on this property. Andreesen will compare other factors and see if it can be more comparable. Otherwise the Board of Review process, they have criteria they would look at if the board wants to dispute it.

Bierschenk moved/Wiley seconded: Approve payment of checks numbered 226780 through 226934, payroll checks numbered 140005 through 140020, and ACH deposits numbered 33957 through 34091 vendor checks numbered 226772 through 226779. Motion carried.

Wiley moved/Bierschenk seconded: To approve Integrated Roadside Vegetation Management (IRVM) internship hiring wage of $13 an hour. Motion carried.

Notification that the 2018 Pictometry flight has begun and they were 40% complete with the planned flight lines. As the imagery is being processed, you can see small amounts of snow along low lying areas. It was agreed, that we will notify Pictometry that we do not feel comfortable with accepting these.

The Engineer discussed the 2018 dust control program provided by secondary roads. The engineer advised that the cost of oil went up some and that the board increase the costs by $40 to cover the expenses.

Bierschenk moved/Wiley seconded: To approve the cost of MC-70 dust control applied by Benton County Secondary Roads for the summer of 2018 at $1,040.00 for two applications of 400 feet each. The cost per additional foot is set at $1.77 per foot for two applications. Dust control permits are to be submitted no later than May 4, 2018. Motion carried

Wiley moved/Bierschenk seconded: To approve IDOT FY19-23 Secondary Road Construction Program. Motion carried.

Wiley moved/Bierschenk seconded: To approve IDOT FY 19 Secondary Road Budget. Motion carried.

Wiley moved/Bierschenk seconded: To approve the Sheriff’s Quarterly Report. Motion carried.

Wiley moved/seconded: To approve the Veteran’s Affairs Quarterly Report. Motion carried.

Bierschenk moved/Wiley seconded: To approve Treasurer’s Quarterly Investment Report ending March 31, 2018. Motion carried.

Wiley moved/Bierschenk seconded: To go into closed session pursuant to Iowa Code 21.5(1)k. Motion carried at 10:56 a.m.

Bierschenk moved/Wiley seconded: To enter back into open session at 11:37a.m. Motion carried.

Bierschenk moved/Wiley seconded: To set public hearing date of Tuesday May 1, 2018 at 9:30 a.m. for a real estate purchase. Motion carried.

Wiley moved/Bierschenk seconded: To go into closed session pursuant to Iowa Code 21.5(1)c. Motion carried at 12:00 p.m.

Wiley moved/Bierschenk seconded: To enter back into open session at 12:41 p.m. Motion carried.

Bierschenk moved/Wiley seconded: To authorize the County Attorney to proceed with what was discussed in closed session. Motion carried.
