The Benton County Board of Supervisors met in regular adjourned session with Supervisors Primmer, Wiley and Bierschenk were present. The meeting was called to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously.

Wiley moved/Bierschenk seconded: To approve the minutes of May 22, 2018. Motion carried.

Bierschenk moved/Wiley seconded: Approve handwritten claim for Employee Benefit Systems, Motion carried.

Wiley moved/Bierschenk seconded: Certify tax suspended list to the Department of Human Services. Motion carried.

Bierschenk moved/Wiley seconded: To approve application for courthouse grounds use by the Vinton Park and Rec Department for Thursday June 21, 2018 from 3-10:00 p.m. and Saturday October 27, 2018 from 8:00 a.m. to noon. Motion carried.

Wiley moved/Bierschenk seconded: To set land use hearing date of Tuesday June 26, 2018 for Caleb Svoboda in part of the NE ¼ SE ¼ 23-85-9. Motion carried.

Wiley moved/Bierschenk seconded: To enter into and authorize the chair to sign the contract agreement between Bear Creek Archeology and Benton County for archeological services associated with the Iowa Watershed Approach project. Motion carried.

Wiley moved/Bierschenk seconded: To set public hearing date of Tuesday July 17th, 2018 at 10:00 a.m. for bid letting for the sale of the old DHS building, property located at 114 E 4th St in Vinton. Motion carried.

The time of 9:15 a.m. having arrived, the board opened the public hearing on a land use change requested by Chad McLaud. Marc Greenlee presented the technical information in accordance with the Benton County Agricultural Land Use Preservation Ordinance. The change in use is for 1 acre located in part of NW ¼ SE ¼ of section 23-85-9. There is an exisiting house and building already on this land. The request is for permission to buy, sell and trade firearms from this location. McLaud has submitted an application to the Bureau of Alcohol, Tobacco, Firearms and Explosives for a federal firearms license. Adjacent land owners have been notified and no response or issues noted. McLaud plans to be open Monday through Friday from 4-8:00 P.M., no weekends, and would not house large inventory and there would not be any gunsmithing at this location. Bierschenk moved/Wiley seconded: to approve the request for a land use change from agricultural to non-agricultural use on approximate 1 acre for federal firearm license use on a parcel generally described as being located in part of NW ¼ SE ¼ of section 23-85-9. Motion carried

Kelly Geater briefly discussed possibly doing some employee sharing for someone to do drives in her office once a week, she was in the advertising process, but had a current county employee interested in job sharing.

Chris Ward and Brian Parr, representing the City of Vinton, came to discuss partnering with the county for Engineer services for re-building West 1st Street in Vinton. The board waited for the Engineer to come and discuss it further. Further discussion on asphalt vs concrete and making it thick enough to handle the weight from secondary roads trucks. Estimating project in 2020. No action was taken at this time.

Wiley moved/Bierschenk seconded: To approve Resolution #18-27, Abate taxes. Motion carried.

RESOLUTION #18-27

WHEREAS, the Benton County Treasurer has reported that three mobile homes have been deemed to have no value by the court pursuant to Iowa Code 562B.27 and Chapters 555B and 648; and

WHEREAS, there are currently tax liens filed against the properties and has determined that it is impractical to pursue collection of the total amount of tax due through the tax sale and the personal judgment remedies and has recommended that the board of supervisors abate the tax on these parcels,

IT IS THEREFORE RESOLVED that the delinquent tax, penalty, interest and costs assessed on the below listed parcels and unpaid through the 2015 assessment year, are hereby abated pursuant to Iowa Code 445.16. The treasurer is directed to strike the amount due from the county system.

#270-12501 – $298.00 in tax, penalty and interest

#28H7419- $400.00 in tax, penalty, and interest

#46979- $213.00 in tax, penalty and interest

Wiley moved/ Bierschenk seconded: To accept retirement notification for Penny Applegarth, Secondary Roads Office Manager effective June 29, 2018. Motion carried.

Bierschenk moved/Wiley seconded: To approve utility permit for Poweshiek Water Association in St. Clair Township for water service. Motion carried.

Bierschenk moved/Wiley seconded: To approve utility permit for East Central Iowa REC in Leroy, St. Clair, Monroe, Bruce and Benton townships to move overhead lines underground. Motion carried.

The supervisors moved the meeting out to the new county purchased building. Benton Development Group, Social Services and the Veterans Affairs department officials along with a few others came to the new location to discuss office layouts and what each envisioned and feels they need. Other topics of interest was the handicap parking, internet drop sites and security.
