May 23, 2017 The Benton County Board of Supervisors met in regular adjourned session with Supervisors Wiley, Primmer, and Bierschenk present. The meeting was called to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously. Primmer moved/ Bierschenk seconded: Approve the minutes of May 16, 2017. Motion carried. Brian Unsen, CPA, along with Tyler Norby from Eide Bailly Audit firm, met with the board to discuss the start of the upcoming FY17financial audit. They will be working on controlled efficiencies from past audits. Wanting to know of any areas of concerns and also discussed the impact for Benton County being the lead county in the new watershed management agency. They will typically make three trips to be on site at the courthouse before the audit is finalized. The time of 9:30 a.m. having arrived, and this being the time and date for a land use hearing for Steve and Rhonda Bernhardt in part of the SE SE of 22-85-9. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Only hearing from one adjoining owner with questions about the location. The Bernhardt's would like to build a new home and change the use of approximately 2.3 acres of agricultural to non-agricultural. The sight will need a new septic and well along with a new driveway. After no further discussion, the land use hearing was closed. Bierschenk moved/Primmer seconded: To approve the land use change from agricultural to non-agricultural on approximately 2.3 acres for a residential purpose on a parcel for Steve and Rhonda Bernhardt in part of the SE SE of 22-85-9. Motion carried. Judy Funk, Heartland Insurance Risk Pool met with the Board of Supervisors to present the renewal illustrations. They had time to review and ask questions. In addition to the renewal estimate, Funk informed the Board of a premium credit that will be applied to the premium due for the FY 18 renewal. Benton County is in a pool along with 10 other counties and is self-funded. Bierschenk moved/Primmer seconded : To enter into and authorize the chair to sign the Client Authorization to Bind Coverage and the Client Confirmation of Schedules and Exposures with Heartland Insurance Risk Pool for insurance coverage for July 1, 2017 through June 30, 2018. Motion carried. The recent legislature's legalization of fireworks in the state has brought about local concerns and questions. Local Pyrotechnicians along with the County Attorney were present for the debated issue. The sale of fireworks will be regulated by licenses from the State of Iowa. There was discussion about age limits, dates and hours allowed for the use of the fireworks. David Thompson advised if the county does nothing, they would be under the operation of the maximum time frame set by the Iowa Code. The county can, by ordinance or resolution, prohibit or limit the use of consumer or display fireworks, but could not prohibit the sale. Auditor Rippel advised that the conservation department will still not allow the use of fireworks inside the county's parks. Sales are slated to start by June 1, 2017, but with the continued wait on administrative rules from the state, there was no action taken. Discussion will continue at the May 30th supervisor's meeting. Bierschenk moved / Primmer seconded: To approve a request for a utility permit by East Central Iowa REC to move utility lines from overhead to underground in the county's right-of-way along 27th Ave. in Taylor Township sections 23 and 24. Motion carried. Bierschenk moved/Primmer moved: To approve a request by ITC Midwest to upgrade fiber optic utility lines in the county's right-of-way in Iowa and Kane Townships. Motion carried. Bierschenk moved/Primmer seconded: Approve payment of checks numbered 223319 through 223483 handwritten check number 22312, payroll checks numbered 139483 through 139499, and ACH deposits numbered 30883 through 31015, vendor checks numbered 223313 through 223318.
