The Benton County Board of Supervisors met in regular session with Supervisors Wiley, Primmer and Bierschenk present. The meeting was called to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously.
Primmer moved/Bierschenk seconded: Approve the minutes from Tuesday, December 5, 2017. Motion carried.
While going through the claims, it was questioned why an invoice is dated March of 2016 and was just now being submitted for payment for service done on the courthouse clock. This will be pulled from the list at this time and discussed further and submitted in the next scheduled claim list.
Bierschenk moved/Primmer seconded: Approve payment of checks numbered 225531, 225538 through 225709, payroll checks numbered 139825 through 139840, 139841 through 139857, and ACH deposits numbered 32765 through 32895, 32896 through 33027 vendor checks numbered 225532 through 225537 and 225710 through 225717. Motion carried.
Discussion was had to clarify appointed Benton County Facility Security Committee members and/or designees. Primmer brought up the concern about those attending the meetings who aren't appointed to the committee, or weren't designated as alternate. The Board agreed to leave as is, if they weren't appointed as designee from the beginning then the appointed committee member should be the only one in attendance. If they are absent, they will receive the minutes.
Primmer moved/Bierschenk seconded: To approve Resolution #17-79, Variance to Sub-Division. Motion carried.
RESOLUTION #17-79
Variance to the Benton County Subdivision Ordinance
WHEREAS, Benton County adopted the Benton County Subdivision Ordinance #72; and
WHEREAS, said ordinance prohibits the creation of multiple splits within a 40-acre aliquot part; and
WHEREAS, said ordinance sets forth the minimum requirements and improvements for subdivisions created in the unincorporated area of Benton County; and
WHEREAS, a request has been presented to the Board of Supervisors by John and Kandice Dennis to vary the required provisions in Article IV, Sections 4.01 through 4.04; Article V, Sections 5.01 through 5.07; Article VI, 6.1 through 6.03; and Article VII, Section 7.01 of the ordinance to allow one additional division on a parcel located in the NE ¼ NE ¼ of 2-82-9.
NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that the requirements of Ordinance #72 are hereby varied as stated for the division of real property located in a parcel within the NE ¼ of NE ¼ in section 2-82-9.

DECLARING CERTAIN INFORMATION CONFIDENTIAL CONCERNING SECURITY PROCEDURES AND EMERGENCY PREPAREDNESS INFORMATION DEVELOPED AND MAINTAINED BY BENTON COUNTY, IOWA, FOR THE PROTECTION OF GOVERNMENTAL EMPLOYEES, VISITORS TO THE GOVERNMENTAL BODY, PERSONS IN THE CARE, CUSTODY OR UNDER THE CONTROL OF BENTON COUNTY, IOWA, OR PROPERTY UNDER ITS CONTROL
WHEREAS, the Benton County Facility Security Committee has recommended, pursuant to the Judicial Branch guidelines for courthouse and public building security in Iowa, that the Benton County Board of Supervisors adopt a rule or policy identifying specific records or class of records as confidential pursuant to Iowa Code §22.7(50)(2017), including, but not limited to, information directly related to vulnerability assessments; information contained in records relating to security measures such as security and response plans, security codes and combinations, passwords, security camera recordings, restricted area passes, keys, and security or response procedures; emergency response protocols; and information in and records that if disclosed would significantly increase the vulnerability of critical physical systems or infrastructures of Benton County, Iowa, to attack, and
WHEREAS, the Benton County Board of Supervisors has determined that disclosure of the above information could reasonably be expected to jeopardize its employees, visitors to its premises, persons in the care, custody, or under the control of Benton County, Iowa, or property under its jurisdiction, and
WHEREAS, the Benton County Courthouse Security Committee, the Benton County Attorney and the Benton County Sheriff concur that such action is appropriate.
THEREFORE, BE IT RESOLVED that information contained in records related to Courthouse security, security measures such as security and response plans, security codes and combinations, passwords, security camera recordings, restricted area passes, keys, and security or response procedures; emergency response protocols; and information contained in records that if disclosed
would significantly increase the vulnerability of critical physical systems or infrastructures of Benton County, Iowa, to attack is declared confidential pursuant to Iowa Code Section 22.7(50)(2017).

Further discussion on the Policy for Disclosure of Security Related Information was had. The board would like to share the proposed policy with Heartland Insurance Risk before they formally adopt. No action was taken.
Bierschenk moved/Primmer seconded: To approve Utility permit for Farmer's Mutual Telephone for placing utility lines in the county's right of way in Benton Township section 28. Motion carried.
Primmer moved/Bierschenk seconded: To approve Utility permit for City of Garrison for placing sewer lines in the county's right of way in Jackson Township. Motion carried.

Larry Andreesen, Assessor talked to the Supervisors and Engineer about the Pictometry projected aerial flight. They would like to see a low flight for the entire county and possibly contributing half of the additional costs out of the Assessor's budget starting in FY19. This will be placed on next week as an agenda item.
Primmer moved/Bierschenk seconded: to enter into closed session pursuant to Iowa Code 22.7(50). Motion carried at 11:05 a.m.
Primmer moved/ Bierschenk seconded: to return to open session. Motion carried at 11:30a.m. No action was taken.
Supervisors looked at a quote provided by ZOLL for a defibrillator to place in the courthouse for $1259.00. They were in agreement to purchase but would like to check with other department heads outside of the courthouse and see if there was a discount for more than one machine if needed in other facilities as well. The Auditor will also check into possible grants that might be available. No action taken.
