The Benton County Board of Supervisors met in regular adjourned session with Supervisors Wiley, Primmer, and Bierschenk present. The meeting was called to order at 1:00 p.m. Unless otherwise noted, all actions were approved unanimously.
The Supervisors spent the afternoon working on finalizing the FY 19 budget. The board also called Bob Josten, bonds attorney with Dorsey and Whitney, LLP to ask some questions regarding general obligation debt.
Bierschenk moved/Wiley seconded: To set public hearing for General Obligation Debt for March 6, 2018 at 9:15 a.m. Motion carried.
Wiley moved/Bierschenk seconded: To approve Resolution #18-12, General Obligation Building Loan Agreement. Motion carried.
RESOLUTION #18-12
Resolution to fix a date for public hearing on a General Obligation County Building Loan Agreement in an amount not to exceed $750,000
WHEREAS, Sections 331.402 and 331.441 of the Code of Iowa authorize counties to enter into loan agreements and borrow money for the purpose of paying the cost of acquiring, remodeling and equipping buildings for use by county employees, provided notice is published and a public hearing is held; and
WHEREAS, the Board of Supervisors (the "Board") of Benton County, Iowa (the "County"), proposes to enter into a loan agreement (the "Loan Agreement") in a principal amount not to exceed $750,000, pursuant to the provisions of Sections 331.402 and 331.441 of the Code of Iowa, for the purpose of paying the costs, to that extent, of acquiring and renovating a building to house County employees; and
WHEREAS, it is necessary to fix a date of meeting of the Board at which it is proposed to take action to hold a public hearing on the Loan Agreement and to give notice thereof;
NOW, THEREFORE, Be it resolved by the Board of Supervisors of Benton County, Iowa, as follows:
Section 1. This Board shall meet on the 6th day of March 2018, on the 2nd floor at the Courthouse, Vinton, Iowa, at 9:15 a.m., at which time and place a hearing will be held on the proposal to enter into the Loan Agreement.
Section 2. The County Auditor is hereby directed to give notice of the proposed action on the Loan Agreement, setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once and not less than 4 nor more than 20 days before the meeting, in a legal newspaper of general circulation in the County.
Section 3. The notice shall be substantially as follows: NOTICE OF PUBLIC HEARING ON LOAN AGREEMENT IN A PRINCIPAL AMOUNT NOT TO EXCEED $750,000
(GENERAL OBLIGATION COUNTY BUILDING)
The Board of Supervisors of Benton County, Iowa, will meet on the 6th day of March, 2018, at the 2nd Floor in the Courthouse, Vinton, Iowa, at 9:15 a.m. for the purpose holding a public hearing on a proposal to enter into a loan agreement (the "Loan Agreement") in a principal amount not to exceed $750,000 for the purpose of paying costs, to that extent, of acquiring and renovating a building to house County employees.
The Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402 and 331.441 of the Code of Iowa and will constitute a general obligation of the County.
At that time and place, oral or written objections or comments may be filed or made to the proposal to enter into the Loan Agreement. After receiving objections or comments, the Board of Supervisors may determine to enter into the Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

Section 4. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.
