The Benton County Board of Supervisors met in regular adjourned session with Supervisors Primmer, Wiley and Bierschenk present. The meeting was called to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously.
Wiley moved/Bierschenk seconded: To approve both sets of minutes from August 14, 2018 as improved. Motion carried.
Bierschenk moved/Wiley seconded: Approve payment of checks numbered 228286 through 228441, payroll checks numbered 140221 through 140236, ACH deposits numbered 35373 through 35514, vendor checks numbered 228442 through 228448. Motion carried.
A farm exemption was presented for Ann Reinberg for land in part of the S1/2 of NE ¼ of 5-83-12. They plan to build 1200-head swine building. Marc Greenlee said it meets all the required criteria for a farm exemption. After pointing out a residence within 600 feet of this proposed site, the board felt it was an inappropriate place. They would like to suggest it have further set back so it was farther away from the nearby residence. No action was taken at this time.
Wiley moved/Bierschenk seconded: To approve Resolution #18-44, Abatement of Taxes. Motion carried.
RESOLUTION #18-44
WHEREAS, the City of Vinton and City of Shellsburg have acquired property and were given the appropriate notice of the taxes due; and
WHEREAS, these entities failed to pay said tax; and
WHEREAS, Iowa Code 445.63 provides that the board of supervisors shall abate the tax if the governing body fails to immediately pay the tax,
IT IS THEREFORE RESOLVED that the 2017 tax assessed against parcels #240-02300 and 190-21350 are hereby abated in full pursuant to Iowa Code 445.63. The treasurer is directed to strike the amount due from the county system.

Wiley moved/Bierschenk seconded: To approve and sign quote for new door on the Benton County Service Center from Automatic Door Group for $12,595.00. Motion carried.
Wiley moved/Bierschenk seconded: To approve the appointment of John Lindaman as Chief Deputy Sheriff, with a salary of 85% of the elected official. Motion carried.
Wiley moved/Bierschenk seconded: To approve Resolution #18-45, Employee Appointments in Sheriff’s office. Motion carried.
RESOLUTION #18-45
EMPLOYEE APPOINTMENTS IN SHERIFF’S OFFICE
WHEREAS, the Benton County Sheriff’s Department has posted positions for various positions within; and
WHEREAS, these employees meet the qualifications required of said positions and are already employees of the Sheriff’s Department; and
WHEREAS, the Sheriff recommended that Rusty Denison be appointed to Jail Supervisor; Ladonna Fairbanks be appointed as Jail Supervisor and Dawn Markland as Communications Supervisor,
NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that these employees’ title status be changed to said appointments in the Sheriff’s Department effective August 21, 2018 with each getting a $2,500.00 wage increase, and after 6-month evaluation of their duties and job performance, they may be able to receive an additional $500.00 per year.

Further discussion was held regarding resource officers in schools. Sheriff Tippett had previously mentioned to the board regarding Benton Community Schools, and since that time has also been in touch with the Belle Plaine Police Chief. The questions regarding how to split the costs was discussed and looking at how the school calendar will impact the position. It was agreed to continue moving forward on the subject matter.
Wiley moved/Bierschenk seconded: To enter into closed session pursuant to Iowa Code 21.5(1)j. Motion carried at 10:06 a.m.
Wiley moved/Bierschenk seconded: To exit closed session and enter into open session. Motion carried at10:30 a.m.
Wiley moved/Bierschenk seconded: To authorize Adam Rodenberg to move forward with what was discussed in close session. Motion carried.
Rodenberg also gave an update on the Middle Cedar WMA. There are 26 entities represented on the WMA Board. A public open house is also planned for Monday September 10th, 4-6:00 p.m. at the UNI campus . The first draft of the plan is expected in December.
Bierschenk moved/Wiley seconded; To approve and sign contract and contractors performance bond with Mathy Construction Co. for HMA resurfacing on D65 (Mt. Auburn east) Project No. FM-CO06(113)—55-06. Motion carried.
Discussed some public concerns regarding the HWY 218 Interchange project detour. Changing a yield sign to a stop sign or put flashing lights on a yield ahead sign to draw more attention. The Board agreed to allow the Engineer to make necessary changes to make it safer.
Wiley moved/Bierschenk seconded: To approve Iowa Department of Transportation Agreements for box culverts and bridge replacements as followed:
IDOT # 6-18-HBP-SWAP-012 for BROS-C006(107)--FF-06 [Box Culvert Replacement on E24],
IDOT #6-18-HBP-SWAP-013 for BROS-C006(109)--SE-06 [Bridge Replacement on 59th St Tr],
IDOT #6-18-HBP-SWAP-014 for BROS-C006(110)--FE-06 [Bridge Replacement on 24th Ave Dr over Bear Creek] ,
IDOT# 6-18-HBP-SWAP-015 for BROS-C006(112)--SE-06 [Bridge Replacement on 51st St Dr over Spring Creek], Motion carried.
Myron Parizek, Engineer requested that the board go into closed session to perform his evaluation.
