The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Bierschenk and Primmer present, The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center. Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Primmer moved/Bierschenk seconded: To approve the minutes of Tuesday, March 1, 2022 and Friday, March 4, 2022. Motion carried.
Bierschenk moved/Primmer seconded: To approve the canvass of the March 1, 2022 Special School Election for Center Point-Urbana Schools as read and declare the public measure in Benton County as passing with 90 yes votes and 28 no votes. Linn County is the control county for Center Point-Urbana Schools, so they will have a 2nd tier canvass to declare the final results. Motion carried.
Primmer moved/Bierschenk seconded: To set land use hearing date of Tuesday, April 5, 2022 at 9:20 a.m. for Ronald and Tamara Wagner in part of the NE ¼ of the NE ¼ of Section 23, T84N, R10W. Motion carried.
Primmer moved/Bierschenk seconded: To approve payroll checks numbered 142160 through 142176, ACH Deposits 48423 through 48561, vendor checks 241730 through 241736 and claims numbered 241737 through 241873. Motion carried.
The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for Luke and Stephanie Cross in part of NE1/4 SE1/4 of 25-83-9. Cross' were both present, no media was present. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Cross's would like to propose a change of the 2.5 acres and build a new home. CSR average is between 30-72, but irrelevant since the ground is not in production. There is an existing driveway that meets the requirements. This site will be able to hook up to Poweshiek Water. Notice was sent to the adjacent owners and published in the newspapers. There were no comments in regards ahead of the meeting. Greenlee pointed out there is some solid waste on the site location and he has received a signed written statement that the owners will get it cleaned up. After hearing no further comments, the public hearing was closed.
Bierschenk moved/Primmer seconded: To approve the land use change Luke and Stephanie Cross in part of NE1/4 SE1/4 of 25-83-9. Motion carried.
Tyler Henkle and Braxton Morrison, Medical Examiner Investigators came to the board to provide an update and how the process works. Dr. Meeker is the County Medical Examiner and can appoint investigators to do the investigations in his absence. There hasn't been an increase in their pay since 2013. They proposed some figures in comparison to other counties similar in size. Discussion also led to if and when Dr. Meeker retires, who will take on the role, or if the county would have to contract the services.
Primmer moved/Bierschenk seconded: To approve the following requested increases for the medical examiner fees:
Standard case -(no more than 3 hours of investigation) $375.00 with $250 of that going to the investigator and the remainder to the medical examiner.
Extreme case-(more than 3 hours of investigation) $625 with $500 to go to the investigator and remainder to the examiner.
Also approving mileage reimbursement for those cases that require long distance travel to be paid at the federal rate, effective July 1, 2022. Motion carried.
The Engineer brought a copy of the Title VI Non-Discrimination Policy Statement along with Title VI, Civil Rights complaint form. The updated policy was approved a few weeks ago, and Parizek gave a brief summary of the effects this could have and advised to get it posted on the county's website and bulletin boards.
Primmer moved/Bierschenk seconded: To adjourn. Motion carried.
