The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Bierschenk and Primmer present, The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center. Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Bierschenk moved/Primmer seconded: To approve the minutes of March 29, 2022. Motion carried.

Armin Martin, Urbana resident who volunteers for the Meals on Wheels program inquired on the need for possibly funding for mileage with the rising fuel costs. Rick Primmer services on the HACAP Board and would check with them and see how that works since the county gives them an allocation already. Martin also shared a cemetery in another county and how they display a directory of the gravesites. He is working along with boy scouts for this to possibly be a project they could work on and make happen in cemeteries near Urbana.

Primmer moved/Bierschenk seconded: To approve Class C Liquor license for Bloomsbury Farm, Inc. Motion carried.

Emily Parker and Alyx Nugent, Riverview center read a proclamation for sexual assault awareness and also explained how the program provides services in Benton County.

Bierschenk moved/Primmer seconded: To approve Resolution #22-27, Signing a Proclamation and Proclaiming April as Sexual Awareness Month. Motion carried.

The time of 9:20 a.m. having arrived, and this being the time and date for a land use hearing for Ronald and Tamara Wagner in part of NE1/4 NE1/4 of 23-84-10. Wagners were both present along with their neighbors George and Pauline Grovert, no media was present. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Wagners would like to propose a change of approximately 2 acres and build a new home. CSR is irrelevant since the land is not in production. There is an existing driveway that meets the requirements currently but if anything is widened in the future they will need to follow the guidelines. This site will need a new well and septic. Notices were sent to 2 adjoining owners and published in the required papers. There were no comments in regards ahead of the meeting, George Grovert spoke up and said he had no objection as long as it's a structurally built home and not a trailer. After hearing no further comments, the public hearing was closed.

Primmer moved/Bierschenkseconded: To approve the land use change for Ronald and Tamara Wagner in part of NE1/4 NE1/4 of 23-84-10. Motion carried.

Bierschenk moved/Primmer seconded: To approve Resolution #22-28, Variance to the Sub Division for Casey Bowman to vary required provisions in Article IV, Sections 4.01 through 4.05; Article V, Sections 5.01 through 5.07; Article VI, 6.2 through 6.03 and 6.05 (f); and Article VII, Section 7.01 of the ordinance to allow for the creation of one new parcel to be created within the SE ¼ SW 1/4, Section 1-T82N-9W.. Motion carried.

Bierschenk moved/Primmer seconded: To approve Auditor's Quarterly Report ending March 31, 2022. Motion carried.

Auditor Rippel handed out a budget report broken down by departments and explained to the Board they will continue to receive this same report quarterly from now on. They need to be able to see if a department goes into the negative they can be aware of and be cautious of department purchases or wage changes if they don't have the proper spending authority.

Shelby Williams, Conservation Director explained her need for FY 22 Budget Amendment due to the FEMA reimbursement and the need to spend that under grounds and maintenance due to the derecho damage. Her request amount is $35,959.91.

Melinda Schoettmer, Treasurer requested a budget amendment in the amount of $11,200 due to staff changes and insurance plan needs for a family coverage instead of single.

Lexa Speidel came to discuss flower pots for the courthouse lawn. In the past different offices have taken turn spending their own money to pay, and the Cottage Society charges $40 per pot, The supervisors agreed they would take their turn this year and each of the three will pay for a pot to be displayed at the courthouse entrances.

Kirsten Nelson, Human Resource Director asked for a budget amendment in the amount of $4,000 for office furniture.

Bierschenk moved/Primmer seconded: To approve Sheriff's Quarterly Report ending March 31, 2022. Motion carried.

Primmer moved/Bierschenk seconded: To set public hearing dates for repealing Ordinance #76, Adopting Ordinance #77 as follows: To waive the third reading, first reading on Tuesday, April 12, 2022 at 9:30 a.m. the second and final reading on Tuesday April 19, 2 022 at 9:30 a.m. Motion carried.

The County Attorney presented another draft of the Benton county Fair Board Loan. The terms of repayment were discussed and the board recommended Thompson share a draft with the Fair Board's attorney before final approval. It will be brought back up at a later date.

Primmer moved/Bierschenk seconded: To set the 2022 MC-70 Dust Control fees. The first 400 feet is $1,450.00 and $2.35 per foot after that with a minimum of 50-foot increments. Motion carried.

Myron Parizek, Engineer presented an update on the HWY 30 Construction. The intersections of 16th Ave. and 19th Ave. and HWY 30 are closed. They are working on 21st. Ave. next, and thru traffic at this intersection will probably be shut off for the duration of the project. Drivers can still travel on Highway 30, but won't be able to make a north or south turn. Also discussed the detour on old Highway 131 and speed limit.
