The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Bierschenk and Primmer present, The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center. Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Primmer moved/Bierschenk seconded: To set land use hearing date of Tuesday May 17, 2022 at 9:15 a.m. for Amana Farms Inc. in part of the NW ¼ NW ¼ of section 26 84-9. Motion carried.

Bierschenk moved/Primmer seconded: To approve the minutes of April 12, 2022. Motion carried.

Primmer moved/Bierschenk seconded: To approve Recorder's Quarterly Report ending March 31, 2022. Motion carried.

Doug Kozik was at the meeting voicing concerns regarding how the detours in his area are affecting the area near HWY 21 and HWY 30. Kozik stressed people need to be aware of the detour and slow down. The Board told them they would check with the Engineer to see about reducing the speed limit and also letting the sheriff know too.

Auditor Hayley Rippel discussed various adjustments to the budget including Auditor and Elections for postage and training. The Middle Cedar Watershed needs more spending authority in anticipation for the grant amendment to cover the additional project incurred. Rippel also explained other areas where amendments were being made. The publication has already been in the paper, but wanted the Board to be aware.

The time of 9:15 being time and place set for a land use hearing for Richard and Marcia Mario for part of the SW of section 27-86-10. They have withdrawn their application and sold the property for other use. Marc Greenlee provided their letter of withdrawal. No action was necessary.

Primmer moved/Bierschenk seconded: To approve the second reading of Ordinance #77, Repealing Ordinance #76, Benton County Precincts. Motion carried.

Primmer moved/Bierschenk seconded: To waive the third reading of Ordinance #77, Repealing Ordinance #76, Benton County Precincts. Motion carried.

Primmer moved/Bierschenk seconded: To approve Resolution #22-29, Adopting Ordinance #77, Repealing Ordinance #76, Benton County Precincts. Motion carried.

RESOLUTION #22-29

ADOPTING ORDINANCE #77, AN ORDINANCE ESTABLISHING THE COUNTY SUPERVISOR DISTRICTS AND ELECTION PRECINCTS AND AMENDING CHAPTER 3 OF THE BENTON COUNTY CODE OF ORDINANCES

WHEREAS, the Benton County Board of Supervisors desires to establish new county supervisor districts and election precincts in accordance with Iowa law and the 2020 census; and

WHEREAS, two considerations of Ordinance #77 where held on April 12, 2022 and April 19, 2022; and

WHEREAS, publication of the considerations were made according to Iowa Code; and

WHEREAS, a copy of said Ordinance #77 has been available to the public in the Benton County Auditor's office;

NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that ORDINANCE #77, AN ORDINANCE ESTABLISHING THE COUNTY SUPERVISOR DISTRICTS AND ELECTION PRECINCTS is fully with an effective date of April 19, 2022, and

FURTHER IT IS RESOLVED THAT CHAPTER 3 OF THE BENTON COUNTY CODE OF ORDINANCES is hereby amended to include said Ordinance 77 and remove Ordinance #76, which is repealed through Ordinance #77, effective April 19, 2022. The Benton County Auditor is directed to publish Ordinance #77 in its entirety in the official newspapers of Benton County.

The Auditor pointed out the wording in the ordinance referring to the City of Vinton, Belle Plaine and Walford having their own Precinct Ordinances. She presented copies of said three ordinances and asked that the Board acknowledge them for record.

Primmer moved/Bierschenk seconded: To acknowledge the Ordinances in place for precincts in the Cities of Vinton, Belle Plaine and Walford. Motion carried.

Mae Hintgen, Mental Health/Disability Services of the East Central Region, Mona Onken, Benton County and Lindsay Upah, representing the Rural Access Hub. The Hub has been in place for over 2 years and the Region is committed to the hub. Hintgen stressed the need for partnership with the county and that the program is a good resource. They wanted to clarify community perception of what the hub does and provided statistics on how many people have been served along with future direction of the Hub. It was agreed this was a good service offered for those in crisis and will continue in the future. Onken will come back at a later time when they can hire another full-time employee to replace Upah, who is going to part-time.

Sandie Degen came to discuss her concerns regarding fireworks permits in Benton County. Degan felt that allowing them until 11:30 p.m. when it isn't a holiday was far too late. She lives near the river and she was speaking on behalf of some of her neighbors as well. Chuck Yedlik was also present and stressed that at his last event a few weeks ago which he had a permit for, they were done

around 9 p.m. There could be others out there shooting them off without permits. The next event Yedlik has a permit for is Memorial Day Weekend. Degen thanked everyone for their time explaining how things worked.

Conservation Board members Mike Lagrange and Randy Scheel were present along with Conservation Director Shelby Williams to present a list of county properties that Conservation maintains versus how they hold title. Their goal is to have the title to all the properties to be consistent. They reviewed each property and how they are maintained. Supervisor Primmer would like to have the County Attorney weigh in on the pros and cons to change titles or having management agreements and will set up a future meeting with everyone present.

Engineer Myron Parizek picked up where he left off in last weeks meeting discussing the IDOT budgets.

Primmer moved/Bierschenk seconded: To approve and authorize signatures on the Iowa Department of Transportation (IDOT) Five Year Secondary Road Construction Plan. (FY 23-FY 27) Motion carried.

The Board mentioned to Parizek about the earlier discussion regarding traffic near HWY 21/30 intersection and possibly lowering the speed limit temporarily.

Bierschenk moved/Primmer seconded: To approve and authorize signatures on the Iowa Department of Transportation (IDOT) FY23 Secondary Road Budget. Motion carried.

Primmer moved/Bierschenk seconded: To adjourn. Motion carried.
