The Benton County Board of Supervisors met in regular session with Supervisors Seeman and Bierschenk present. Primmer was absent.

The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center.

Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Summarized Resolutions will be available in the Auditor's office and at: www.bentoncountyia.gov

Seeman moved/Bierschenk seconded: To approve the minutes from Tuesday, October 4, 2022 with a fix on Resolution #22-91. Motion carried.

Bierschenk moved/Seeman seconded: To approve payroll checks numbered 142508 through 142520, ACH Deposits 50783 through 50932, claims numbered 243975 through 244132 and vendor checks 244133 through 244139. Motion carried.

Bierschenk moved/Seeman seconded: To approve Auditor's Revised Quarterly Report ending September 30, 2022. Motion carried.

Bierschenk moved/Seeman seconded: To approve Recorder's Quarterly Report ending September 30, 2022. Motion carried.

Bierschenk moved/Seeman seconded: To approve Sheriff's Quarterly Report ending September 30, 2022. Motion carried.

Bierschenk moved/Seeman seconded: To approve the ISAC HIPAA Hybrid Entity Designation. Motion carried.

Bierschenk moved/Seeman seconded: To approve vendor change for the flexible spending to P.R.I.M.E. Benefits effective January 1, 2023. Motion carried.

Bierschenk moved/Seeman seconded: To approve use of courthouse lawn for Vinton Parks and Recreation Department for Saturday, October 29, 2022. Motion carried.

Bierschenk moved/Seeman seconded: To approve Resolution #22-95, LOSST Gift to Canton-Benton-Shellsburg Fire Association. Motion carried.

RESOLUTION #22-95

WHEREAS, the Benton County Board of Supervisors has established a program for gifting funds to emergency service providers who provide services within the unincorporated area of Benton County; and

WHEREAS, the Canton-Benton-Shellsburg Fire Association has requested a gift of funds; and

WHEREAS, the Canton-Benton-Shellsburg Fire Association provides emergency services to areas in Benton and Canton Townships, City of Shellsburg and mutual aid to other surrounding townships;

WHEREAS, the Canton-Benton-Shellsburg Fire Association has provided invoices totaling $586,788.79.00 for the purchase of an emergency response truck and pumper; and

WHEREAS, Canton-Benton-Shellsburg Fire Association agrees that the vehicle obtained with the proceeds of this gift shall be used when necessary for rural fire protection and/or life support operations, consistent with the intended use of the money from the Local Option Sales and Services Fund,

NOW THEREFORE BE IT RESOLVED that the Benton County Board of Supervisors approves an Emergency Services Gift to the Canton-Benton-Shellsburg Fire Association in the amount of $58,678.88 which represents ten percent of the total purchase price for equipment.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for Colton Kinzenbaw in a part of SE ¼ of the NW ¼ of Section 11-82-11. Colton was present along with the land owners Leo and Karen Kinzenbaw and a few other family members. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Kinzenbaw would like to build a new chaus. The site has an existing driveway that meets all the criteria. No well is needed, rural water is already there but it will require a new septic. Legal notices were published and four adjacent owners were notified. Greenlee felt this was a good project and didn't see any issues. Bierschenk moved/ Primmer seconded: To approve the land use hearing change for Colton Kinzenbaw in a part of SE ¼ of the NW ¼ of Section 11-82-11Motion carried.

Bierschenk moved/Seeman seconded: To approve Resolution #22-96, Approve FY 23 Budget Amendment. Motion carried.

RESOLUTION #22-96 2 BE IT REMEMBERED on this, the 11th day of October, 2022, the Board of Supervisors of Benton County, Iowa, met in session for the purpose of hearing on an amendment to the current operating budget adopted on March 15, 2022. There was a quorum present as required by law. Thereupon, the Board found that the notice of time and place of the hearing had been published. Thereafter, and on said date the amendment was taken up and considered. Thereafter, the Board took up the amendment to the budget for final consideration and determined that said budget be amended as follows:

Dean Vrba, Transportation Director discussed wages for drivers with a Class D3 Chauffer's license. The Board asked that he prepare a resolution and do it that way. So no action was taken.

Bierschenk moved/Seeman seconded: To approve Resolution #22-97, Applying for IDOT FY 23 Living Roadway Trust Funds Grant. Motion carried.

R E S O L U T I O N #22-97

WHEREAS, Benton County has applied for Fiscal Year (FY) 2023 Living Roadway Trust Funds for a Skid Mounted Sprayer, and WHEREAS, this equipment will make the local IRM program more effective, and

WHEREAS, the IDOT has approved for funding up to $15,000 for the application submitted, and

WHEREAS, the IDOT has prepared a project development agreement,

BE IT THEREFORE RESOLVED by the Benton County Board of Supervisors that the project development agreement be approved, and

BE IT FURTHUR RESOLVED by the Benton County Board of Supervisors that Roadside Biologist, George Haefner be authorized to sign and execute the project development agreement.

BE IT FURTHUR RESOLVED by the Benton County Board of Supervisors that Roadside Biologist, George Haefner be authorized to sign and execute the project development agreement.

Kevin Atkinson was at the meeting for public comments. He asked for an explanation for why he wasn't chosen to be the vegetative roadside manager. Atkinson said as a veteran, he had the right to know. Atkins also explained Veterans preference referring to section 35C, and asked if they even discussed this. Supervisor Bierschenk said they did not. Supervisor Seeman told him to check with human resources for the requested documentation, that the Board hired based on the hiring committee's recommendation.
