The Benton County Board of Supervisors met in regular session with Supervisors Primmer, Bierschenk and Seeman present. Supervisor Primmer called the meeting to order at 9:00 a.m. at the Benton County Service Center. Members of the public are invited to join in during open session or watch the livestream at https://www.youtube.com/bentoncountyiowa. Seeman moved/Bierschenk seconded: To approve the agenda. Seeman, Primmer and Bierschenk voting aye. Motion carried.

Seeman moved/Bierschenk seconded: To approve the minutes from August 13, 2024. Primmer, Seeman and Bierschenk voting aye. Motion carried.

Seeman moved/Bierschenk seconded: To approve Special Class C Retail Alcohol License effective September 18, 2024 through October 1, 2024 for Kacena Family Tree Farms. Primmer, Seeman and Bierschenk voting aye. Motion carried.

Seeman moved/Bierschenk seconded: To approve Resolution #24-80, Amending Resolution #24-73, Handbook Revision to Sections 4.2-4.5 Leave Section, making it go into effect January 1, 2025, upon the employee's anniversary date. Primmer, Seeman and Bierschenk voting aye. Motion carried.

Seeman moved/Bierschenk seconded: To approve utility permit for Alliant Energy in Cedar Township. All members voting aye. Motion carried.

Seeman moved/Bierschenk seconded: To approve Resolution #24-81, Approving hiring Shane Clark to be the Grade Working Foreman with a base wage of $29.47 effective August 26, 2024. Primmer, Seeman and Bierschenk voting aye. Motion carried.

Ray Lough, County Attorney addressed the Board about the Human Resources Department. Negotiations on behalf of the county began when Sue Wilber's attorney had approached the attorney at Heartland Insurance Risk Pool about a separation agreement which included a lump sum payment along with other obligations. The county didn't feel that they should have to pay the settlement, so Heartland agreed to pay on the county's behalf. Lough is currently receiving all of Sue Wilber's emails and wanted to discuss some options and present some proposals with the board to look through before taking action how to proceed after the vacancy. No action was taken on that.

Seeman moved/Bierschenk seconded: To accept resignation of Sue Wilber effective August 16, 2024. All members voting aye thereon. Motion carried.

Tim Sage, Representing Salem Cemetery Association came to discuss increase the fees for care of soldiers graves. The board wanted to research this topic more and took no action.

Seeman moved/Bierschenk seconded: To enter into closed session at 9:32 a.m. Pursuant to Iowa Code Section 21.5(1)(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation. Primmer, Seeman and Bierschenk voting aye. Motion carried.

Seeman moved/ Bierschenk seconded: To exit closed session at 9:42 a.m. The Board allowed time for public comments after the closed session.

Seeman moved/Primmer seconded: To Adjourn at 9:49 a.m. Primmer, Seeman and Bierschenk voting aye. Motion carried.
