After several months investigating a heartless and disrespectful act of vandalism, charges have been filed on five suspects from the Cedar Rapids area for the vandalism at the Evergreen Cemetery back in the early hours on September 14, 2014: Johnathan Fay, 24, Arianna Devereux, 19, Daniel Anderson, 26, Christian Severson, 20, and Jesse Clark, 22, all of Cedar Rapids. All subjects have be charged with Criminal Mischief 2nd Degree and Trespass (Serious Misdemeanor), with the exception of Jesse Clark who will only be charged with Trespass.

Criminal Mischief 2nd is a class “D” Felony which carries up to five (5) years in confinement and shall be fined no less than $750.00 up to no more than $7,500.00. A Serious Misdemeanor carries a fine amount of at least $315.00 with no more than $1,875.00 and may be confined up to a year in confinement.

Agencies assisting in the investigation with information reference the case included the Benton County Sheriff’s Office and Cedar Rapids Police Department.

The suspects allegedly knocked over and damaged 22 headstones, some dating back to the 1800’s. The investigation into another prior incident is still under investigation.

*An arrest or criminal charge is merely an accusation and the Defendant(s) is presumed innocent until and unless proven guilty in a court of law.

This was a mistake, and they will probably not have to pay what they should for this, costing other people time and money to fix this \"mistake\" There are no excuses for this type of behavior NONE.
WG December 26, 2014, 1:07 pm I agree, each of these individuals are all adults over the age of majority in Iowa. Since they didn\'t learn respect for property or authority in their homes growing up, they need to learn it by paying the consequences for their actions. Therefore, as and since they are adults and definitely in the - far from \"know better than to do something like this\" stage, yet chose to perform malicious willful harm and damage to property; I personally believe that not only should each adult serve max prison time, but also they should pay the max fine. For an extra lesson in how to be a good citizen, I believe the judge should set a five year probation upon each adult being released from prison, to include a mandatory number of hours spent during those five years - restoring, under strict supervision, the older grave yards and head stones in Benton County. In other words give them some maximum community service too.
