Stacy Diveley was arrested on the same charge that brought her a prison term just a week earlier. She was arrested for one count of Child Endangerment, an aggravated misdemeanor. She was tried in June for her original crimes, found guilty and sentenced to no more than 7 years in prison on July 1, 2024.
According to court records, the last line in the judge's ruling indicates that she is free while she appeals the ruling. Posting $15,000 in bonds. The filing reads, "Appeal Bond $2,000 Each Ct. I, II, III, V, VI and $5,000 FOR CT IV." The judge gave the appeal process 90 days to complete the appeal.
At the time of her second arrest exactly a week later, July 8, 2024, she was still not imprisoned.In the second arrest, she was released on $2,000 bail with a promise to appear next Wednesday, July 17, 2024, at 8:30 a.m.
Jeffrey Diveley was also arrested for the second time. He is out following his arrest on September 19, 2022 and posting $140,000 cash only bond.
This arrest adds a charge of Grooming, a Class D Felony. He posted a $5,000 bond with a promise to appear, at the same time as his wife on Wednesday, July 17, 2024, at 8:30 a.m.
His original trial has been rescheduled several times and is now scheduled for December 2, 2024 at 9:00 a.m. He faces 10 charges which include:Two counts of Sexual Abuse in the 2nd Degree, a Class B FelonyTwo counts of Sexual Abuse, 3rd Degree, a Class C FelonyTwo counts of Continuous Sexual Abuse of a Child, a Class B FelonyTwo counts of Lascivious Acts with a Child, a Class C FelonyTwo counts of Assault with Intent to Commit Sexual Abuse, an Aggravated Misdemeanor
He too is out on bond as he awaits trial.
