In the case of Jeffrey Diveley, 64 of Shellsburg, sentencing was issued on Friday, February 7, 2025. The judge sentenced Diveley to 40 years in prison, but said that it is possible that Diveley will only serve 25-30 years. Diveley is currently being held at the Iowa Classification Center in Coralville.
Four of the charges, 9-11 and 13 made the defendant unbailable at the time of the verdict. Diveley was immediately handcuffed and taken into custody following the jury verdict where he was kept in the custody of the Benton County Jail.
Diveley's charges are CORRECTED and listed below. An asterisk indicates the lower charge determined by the jury. Following each charge is the sentence imposed by the judge:

Sentences in Counts 5, 12, 13 will run consecutively.
In Counts 7 and 14 the sentences will run concurrently.
The Defendant will serve 40 years in prison with credit for time served with the fine suspended.
Sentence in Counts 1, 5, 9, 10, 11, 12, 13 begin upon the completion of the sentence imposed.
A special sentence is also imposed in Counts 7 and 14 to begin upon the completion of the sentence imposed.

Im hoping the legal system looks at this type of terrible crime, and sentences are to the maximum penalty.
There should not be any plea deals involved at all !!!

Stacy and Jeff, your lies have never been founded as truthful. It’s so easy to read what your next steps are going to be to try and get out of the large trouble you created. It will not work. Never has. History repeats... may you never see freedom ever again. What you did cannot be undone. You will face your consequences and never feel the suffering put forth to those KIDS. I pray the next case serves the best the justice system has to offer.
If nothing else this should urge people to write to their elected officials and ask them to do something about this! Simplify the code for ALL sexual assaults.. it shouldn't be pages and pages of definitions and elaborated scenarios! WRITE YOUR STATE ELECTED OFFICIALS!!
Editor's Note: They didn't "have to charge him with a whole mess of charges" they did so because they felt he was guilty of that many charges. I could have eliminated what he was originally charged with, but felt it was important to list the original charge and what he the jury felt like was deserved. Hope that helps.
