In the Compensation Board meeting last week, Supervisor Tracy Seeman said that he had misspoken when it came to the wages set by Conservation, Assessor and the Board of Health. He corrected his statement at this week's supervisor meeting. He said that these boards typically will match whatever is decided for the other officials. He apologized for the error.

Last week. a flyer was being handed out concerning the "officialness" of the county officers. It was stated that they had not been properly sworn in to perform their duties. The post has been shared on Facebook and via flyers and etc.

In this week's supervisor's meeting, the elected officials said that the information shared was "inaccurate" and attorney for Benton County, Derek Marsh said that they cannot address it further as it is "being litigated."  

The Benton County Sheriff's office said that they are aware of the post/flyer. Currently, the procedure for the hiring of a deputy is that they are sworn in by a judge. Under Sheriff Upah, this is standard procedure. Any deputy hired is fully authorized to perform their duties.

"Let it be known to ALL People of Vinton and Benton County of the following: The following VINTON, Benton County deputies, or former deputies acted outside of their authority between the summer of 2022 (Their respective hire date) through 1 January 2025. 

1. Dmitry Nikolaev (former deputy) 

2. Victor Rohrbach (active deputy) 

3. Eric Recker (active deputy) 

The above-mentioned deputies failed to qualify their appointment as deputies by failing to acquire the Mandatory OATH OF OFFICE pursuant to the Iowa code chapter 63.1, 63.8, 63.10 and Title 5 U.S. Code § 3331 and as outlined in the - Constitution of The United States of America, and the Constitution of lowa. 

1. What does this mean?

 It means that any citation or arrest initiated by them was and is void and invalid. All traffic citations, tickets, fines, and fees issued to all People of Benton County are void ab initio (void from the beginning) from these deputies until 2 January 2025. 

2. Why is this important?

In essence these deputies were IMPERSONATING AN OFFICER; 18 U.S. Code $ 912 & 913, and lowa code 718.2. This is a serious offense. It also means that the Benton County Attorney had / has NO JURISDICTION AND NO STANDING to prosecute any of these deputies' cases that came vefore him from the time these deputies were hired until 2 January 2025. 

3. How could this happen?

Simple, Ronald Tippett, former Benton County sheriff, and now sits on the Benton County Board of Supervisors, was known by the Benton County Auditors office to not perform his job duties. One of which is to administer the Oath of Office to all of his deputies at the time of their hiring.
