The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Primmer and Bierschenk present. The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center. Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Primmer moved/Bierschenk seconded: To approve out of state training for Mona Onken. Motion carried.

Bierschenk moved/Primmer seconded: To approve the minutes of December 13, 2022 with adding the word chemicals where discussed. Motion carried.

Primmer moved/Bierschenk seconded: To approve 24 hours of vacation carryover for Sarah Wagner to be used by March 31, 2023. Motion carried.

Primmer moved/Bierschenk seconded: To acknowledge the Benton County Fair Board's repayment of the $60,000 and $1,119.45 interest on the loan from Local option Sales and Service Tax Fund. Motion carried.

Liz Rodriguez met with the board regarding the signed shared liability agreement approved last week with the East Central Iowa Workforce Development and asked if there were any questions. Rodriguez provided an update and explained how the entity is looking to get Title 1 grant funds. Benton County is in this group along with Jones, Johnson, Cedar, Iowa and Washington Counties. The grant amount was $22 million this year and current fiscal agent is Johnson County. Jones County is the employer of record and they are looking at East Central Iowa Council of Governments (ECICOG) to coordinate the funds.

Bierschenk moved/Primmer seconded: To approve Resolution #22-114, Wage and classification change for Shane Clark in secondary roads has obtained a Labor Grade classification IVD at hourly rate of $25.84 effective December 27, 2022. Motion carried.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for Dan Wirtanen in a part of Parcel A, in the SE of the SE of Section 15-83-9. Wirtanen was unable to attend. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Wirtanen would like to build an event center on this building site. Previously he was granted approval for an Air BNB, but this is a new non ag use request. The site has an existing driveway that meets all the criteria and is off a hard-surfaced road. This new site will need a new septic system and it has access to rural water with a public well. No comments were heard for or against this change. Public hearing was closed.

Primmer moved/Bierschenk seconded: To approve the land use hearing change for Dan Wirtanen in a part of Parcel A, in the SE of the SE of Section 15-83-9. Motion carried

Primmer moved/Bierschenk seconded: To approve and enter into 28 E Agreement for Maintenance of Farm to Market Extension(s) within the City of Norway, Iowa. Motion carried.

Primmer moved/Bierschenk seconded: To enter into closed session at 10:17 a.m. pursuant to Iowa Code 21.5(1)c for pending litigation update provided by Kristymarie Shipley. Motion carried.

Primmer moved/Bierschenk seconded: To exit closed session at 10:36 a.m. Motion carried.\

No action needed after the closed session.

Bierschenk moved/Primmer seconded: To approve waiver of separation distance for manure storage structure per Iowa Code Section 459.205 for Geno Source LLC at 2188 78th Street, Blairstown. Motion carried.
