In September of 2022 a Shellsburg couple, Jeffrey and Stacy Dively, were arrested on several crimes involving children. In May of 2024, Stacy Diveley, 47 was finally brought to trial.
She was charged and found guilty of the following:
Count 1 - Child Endangerment, Aggravated Misdemeanor
Count 2 - Child Endangerment - Aggravated Misdemeanor
Count 3 - Child Endangerment - Aggravated Misdemeanor
Count 4 - Child Endangerment - Bodily Injury, Class D Felony
Count 5 - Child Endangerment - Aggravated Misdemeanor
Count 6 - Child Endangerment - Aggravated MisdemeanorCount 7 - Dismissed - Tampering with a Witness
In count 2, the charge of Child Endangerment with Bodily Injury, a Class D Felony,the charge was reduced to Child Endangerment dropping it to an aggravated misdemeanor charge.
Sentencing:
In Counts I, 2, 3, 5 and 6 she was sentenced to 2 years on each count to be served concurrently, (served at the same time)
On count 4, she was sentenced to serve 5 years
Counts 1,2,3 is to be served at the same time and following Counts 4,5,6.
Counts 5 and 6 will be served consecutively to each other.
Count 4 to run consecutively w/ cts 1,2,3 concurrently to 5 and 6
Summary:
She will first serve 4 years for counts 5,6 (2 years each) and then
5 years for count 4 consecutively with 2 years for Counts 1,2,3 ]
Not to exceed 7 years.
She will get credit for time served and may be eligible for parole.
A fine was imposed of $855 for each count 1,2,3,5,6 and $1,025 for Count 4.
In the case of Diveley's husband Jeffrey Diveley, 63, he is scheduled to go to trial on December 2, 2024 at 9:00 a.m., subject to change. He faces ten charges of abuse over the course of several years with more than one child.
His charges include the following:
COUNTS 1 AND 6 - SEXUAL ABUSE 2ND DEGREE, a Class B Felony
COUNTS 2 AND 7 - CONTINUOUS SEXUAL ABUSE OF A CHILD, a Class B Felony
COUNTS 3 AND 8- LASCIVIOUS ACTS W/CHILD, Class C Felony
COUNTS 4 AND 9 - SEXUAL ABUSE 3RD DEGRE, Class C Felony
COUNTS 5 AND 10 - ASSAULT W/INTENT TO COMMIT SEXUAL ABUSE, Aggravated Misdemeanor
